Terms of service
These terms are the agreement between you and AMTDA GLOBAL LLC for the Startline app. Installing Startline or using it means you accept them. If you do not accept them, do not use the app.
1. What Startline is
Startline builds a running plan for a race day you choose and reads each session to you while you run. It is a training plan and a spoken session, and nothing more. It is a tool you use; it is not a person, and it is not a service delivered to you by a person.
2. Training is your own responsibility
Training is your decision and your responsibility. Startline hands you a plan and speaks it; it does not know you, it cannot see you, and it cannot judge how a session is going for you. Only you can do that. Ease off, cut a session short, or stop, whenever you judge you should. If you are unsure whether a session suits you, ask a qualified person for advice before you run it. AMTDA GLOBAL LLC is not responsible for the training decisions you make.
3. You must be an adult
Startline is for adults. You must be eighteen or older to use it. Do not use it if you are not.
4. Your licence to use the app
AMTDA GLOBAL LLC grants you a personal, revocable, non-exclusive and non-transferable licence to use one copy of Startline on devices you own or control, for your own use. You may not sell it, rent it, sub-licence it, take it apart, decompile it, or try to derive its source, except where the law says you may do so regardless of this paragraph.
5. Your data stays on your phone
Everything Startline records — your plan, your weekly log, and every run with its route — is written to your own phone and to nowhere else. It is yours. AMTDA GLOBAL LLC never receives it and cannot read it. The privacy policy sets out exactly what is written and where.
Because of that, there is one thing you should understand plainly: there is no backup and no restore. Startline as it stands today does not copy your plan or your runs to a server or to another device. If you remove the app, or the phone is lost, replaced or wiped, everything Startline held on it is gone and cannot be recovered by you or by us.
6. What Startline costs
Today, Startline charges nothing. There is no purchase, no subscription and no payment of any kind inside the app as you have it now. No card details are asked for, because there is nothing to buy.
A paid plan is planned for a later release. If and when one is added, it works like this, and this paragraph is written now so it is true the day it arrives:
- Monthly. The paid plan is a monthly subscription. The price is shown on screen, in your own currency, before you are asked to buy anything.
- It renews monthly. It renews once a month, on the same day, until you cancel it. Each renewal is charged at the price shown when you subscribed, unless a price change is announced to you first and you accept it.
- Cancel any time. You cancel through the store, not through us: in App Store settings on an iPhone, or in Google Play subscription settings on Android. Cancel at least twenty-four hours before the next renewal date and you are not charged again. You keep what you paid for until the end of the period you already paid.
- No trial that turns into a year. There is no free trial that converts into a yearly charge, and there is no yearly charge presented as if it were a monthly one.
- Payment is the store's. Apple or Google takes the payment, holds your payment details and issues your receipt. AMTDA GLOBAL LLC never sees a card number.
- Refunds are the store's too. Refunds are decided by Apple or Google under their own rules. Write to us anyway if something went wrong and we will help you where we can.
7. How you may use it
Use Startline for your own training. Do not use it in any way that breaks the law, do not interfere with it or with the devices of others, and do not present it as your own product or as a product of anyone else.
8. No connection with any race
Startline is not connected with, endorsed by or sponsored by any race, event, series or organising body. It plans for a distance, not for a brand. Names of distances are used only to describe what the plan is for.
9. The app is provided as it is
Startline is provided as it is and as it is available, without warranties of any kind, whether stated or implied, including any implied warranty of merchantability, of fitness for a particular purpose, or of non-infringement. AMTDA GLOBAL LLC does not promise that the app is free of faults, that it works without interruption, that a spoken cue always arrives at the moment it is due, or that a phone always records a route correctly. A phone can pause an app, deny it location, run out of power, or fail. Plan for that.
10. Limit of what we owe you
To the fullest extent the law allows, AMTDA GLOBAL LLC is not liable for indirect, incidental, special or consequential loss arising out of your use of Startline, including a lost plan, a lost run log or a missed session. Where liability cannot be excluded, it is limited to the amount you have paid us for the app in the twelve months before the claim, which today is nothing. Nothing in these terms limits any liability that cannot be limited by law.
11. Changes
Startline may change. Features may be added, altered or withdrawn from one release to the next. These terms may change too; the current version is always at [DOMAIN]/terms.html with its effective date at the top. If a change matters to you, it is described in the release notes for the version that carries it. Continuing to use the app after a change means you accept the new terms.
12. Ending this agreement
You may end this agreement at any time by removing Startline from your devices. AMTDA GLOBAL LLC may end it if you break these terms. Sections 5, 9, 10 and 13 carry on after it ends.
13. Governing law
These terms are governed by the laws of the State of Texas, United States of America, without regard to its rules on conflict of laws. The courts of that state have jurisdiction, except where the law of the place you live gives you the right to bring a claim where you are.
14. The whole agreement, and Apple's part in it
These terms are the whole agreement between you and AMTDA GLOBAL LLC about Startline. If a court finds one part of them unenforceable, the rest stands.
For the version obtained from the App Store: this agreement is between you and AMTDA GLOBAL LLC only, not with Apple. Apple is not responsible for Startline or for its content. Apple has no obligation to give you any support for it. If the app fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price, if any; beyond that, Apple has no other warranty obligation at all. AMTDA GLOBAL LLC, not Apple, is responsible for any claim about the app, including product liability claims, claims that the app fails to meet a legal requirement, and claims brought under consumer law. AMTDA GLOBAL LLC, not Apple, is responsible for investigating and settling any claim that the app infringes someone's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
